Terms of Service
These terms cover your use of IgniteX ("the Software"). Read them carefully. by installing the Software or buying energy you agree to all of this. If you don't agree, don't install it; we'll be sad but we'll respect it.

What this contract covers
"The Software" means the IgniteX desktop application as released at the time you download it (installer, editor binary, bundled engine runtime, embedded host UI, and all assets that ship inside the installer), together with the minor and patch updates (sometimes called "feature updates" and "bug-fix updates") we publish under the same major version line for the duration set out in section 11 ("Updates"). It does not include:
- AI usage itself — which runs on energy from a paid subscription — and any cost charged by third-party model providers. AI usage is separate from the free Software license.
- Cloud storage, hosting, multiplayer servers, or any other service we don't explicitly bundle in the installer.
- Free AI credits, trial offers, gift cards, or promotional bonuses we may offer from time to time.
- Major version upgrades released under a new major version number, which may be offered as a separate purchase or upgrade at our discretion.
- Any features or functionality we explicitly mark as "preview", "beta", "experimental", or similar. these may be removed or changed without notice and are not part of the licensed Software for warranty purposes.
"Major version", "minor version", and "patch version" follow the conventional semantic versioning model: a major version change is one that introduces breaking changes or significant new capabilities and is signalled by an increase in the first number of the version string (for example, going from 1.x.x to 2.x.x). We reserve the right to determine what constitutes a major version in good faith.
Your license
IgniteX is free to download and use. You receive a non-exclusive, non-transferable license to install and use the Software on machines you personally own or control, with no revenue cap and no royalty. Specifically:
- You can install on multiple machines you use yourself (laptop, desktop, work, etc.). This is a per-user license, not per-machine.
- You can use the Software commercially, including to build and sell games, with no limit on what those games earn. We never take a cut of your game revenue.
- You own the games you create with IgniteX. The scene, script, and asset files on your disk are yours. We retain no rights to your output.
- You may not resell, sublicense, or redistribute the Software itself, or share your account credentials or access codes with other people.
- You may not reverse-engineer, decompile, or extract the Software's source for purposes of recreating or competing with IgniteX.
The only thing you ever pay for is energy — a monthly subscription that powers the built-in AI (see section 3). It's optional: the Software and the games you've made keep working whether or not you have an active energy plan. Separately-marketed future products may require their own purchase.
AI & energy
IgniteX is an editor that sends your prompts to an AI model to generate edits. That model runs through our hosted gateway and is billed with energy.
Built-in AI (energy). IgniteX routes your prompts through our hosted gateway to a model provider using our API keys. Each turn meters the work done and deducts energy from your monthly allotment. Energy is sold as monthly subscription plans; prices and monthly allotments are shown at checkout and may change for future billing periods. Energy is a consumable digital good: it has no cash value, your unused allotment rolls over while your subscription is active, and it is spent as you use the AI. You can cancel anytime, which stops future charges.
When you use the built-in AI, your prompts and the project context needed to answer them pass through our gateway to the model provider so we can return the edit and meter usage. We don't sell that content or use it to train models. (See Privacy.)
Energy purchases & promotional credits
Energy is the subscription credit that powers the built-in AI (section 3). Each billing period your plan's energy is added to your account; unused energy rolls over and does not expire while your subscription stays active. Energy is consumed as you use the built-in AI.
From time to time we may also grant promotional energy — launch bonuses, trial credit, or goodwill top-ups. These grants are a courtesy, not a contractual obligation:
- Promotional energy has no cash value and cannot be transferred, withdrawn, or refunded.
- We can change, reduce, expire, or discontinue any promotional offer at any time, for any reason, without notice.
- The discontinuation of a promotional offer does not give you grounds for a refund or any other claim against us.
- If you run out of energy, the editor keeps working; your allotment refills at the start of the next billing period, or you can upgrade your plan for more.
Your content & what we don't promise about it
IgniteX generates code, scenes, scripts, and assets in response to your prompts. The AI model is provided by a third party. We make no warranties about what gets generated. Specifically:
- We do not guarantee that AI-generated code is correct, secure, performant, or fit for any particular purpose.
- We do not guarantee that AI-generated content does not infringe third-party intellectual property. You are responsible for reviewing the output before shipping anything publicly.
- We do not guarantee that prompts will succeed, that builds will compile, or that the game you envisioned will be the game you get.
- We are not liable for damages caused by AI-generated output. including but not limited to: data loss, IP claims, broken builds, security vulnerabilities, or business losses.
You are solely responsible for the games and content you create with IgniteX, including their distribution, support, and any legal consequences.
Refund policy
The Software is free, so there's nothing to refund there. This policy is about energy purchases.
You can request a refund of unused energy within 7 calendar days of a charge by emailing hello@ignitex.app from the address on your account. We'll return the portion of that charge still sitting in your balance and process it within 7 business days. You can also cancel anytime to stop future charges.
Because energy is a consumable we spend with the model provider on your behalf the moment you use the built-in AI, the following is not refundable:
- Energy you have already spent on AI turns. it's been consumed and the compute is gone.
- Promotional or bonus energy, which has no cash value (see section 4).
- Any charge where we reasonably believe the request is an attempt at fraud, such as subscribing, spending most of a period's energy, and then asking for a full refund, or repeated subscribe-and-refund cycles.
After the 7-day window closes, that billing period's charge is final. We don't pro-rate beyond returning your unused balance, and we don't refund third-party model-provider charges under any circumstances.
Where consumer-protection law in your jurisdiction gives you a non-waivable right to a refund or cooling-off period that is more generous than this clause, that statutory right applies in addition to (and prevails over) the rules above.
No warranties
The Software is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim:
- Implied warranties of merchantability and fitness for a particular purpose.
- Warranties of non-infringement.
- Warranties that the Software will be uninterrupted, error-free, or compatible with any specific hardware or third-party service.
Some jurisdictions don't allow these disclaimers. in that case they apply to the maximum extent permitted there.
Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the Software is limited to the amount you actually paid us (for energy) in the 12 months before the claim arose. Since the Software itself is free, for many users that figure is $0.
We are not liable for any indirect, incidental, consequential, special, or punitive damages. including but not limited to:
- Lost profits, lost revenue, lost data, or lost business opportunities
- Damages resulting from AI-generated output
- Damages resulting from third-party API providers (Anthropic, OpenAI, etc.) raising prices, suspending service, or terminating your account with them
- Damages resulting from games or content you publish using the Software
This limitation applies even if we've been advised of the possibility of such damages.
Acceptable use
You agree not to use IgniteX to:
- Create games that violate any law (CSAM, incitement to violence, fraud, etc.).
- Attempt to circumvent the Software's licensing, billing, or update mechanisms.
- Probe, scan, or attack our infrastructure or that of model providers we route to.
- Resell, sublicense, or rebrand the Software as your own.
- Use the Software in safety-critical contexts (medical devices, aviation, nuclear plants. anywhere people die if the software fails).
We may terminate your license if you violate these rules, with no refund.
Account & termination
You can stop using IgniteX at any time. uninstall it, delete your account, walk away. We can terminate your license if you breach these terms, with notice if practical.
If we terminate for cause (e.g. licensing fraud or acceptable-use violation), no refund. If we terminate without cause (e.g. we shut the company down), we'll pro-rate a refund and provide a final installer build that doesn't require our servers to function.
Updates to the Software
We may release updates that fix bugs, change features, or add new capabilities. Minor and patch updates released under the same major version as the version you purchased are included with your license at no additional cost, for as long as we continue to publish them.
We make no commitment to release any specific number of updates, to release updates on any specific schedule, or to release updates indefinitely. We may discontinue updates for any major version at any time and may end commercial support for older versions with reasonable notice.
We make no commitment that any specific feature will remain in the Software in any future update. Features may be added, modified, deprecated, or removed (for example, due to security issues, deprecated dependencies, or business decisions). We will document material changes in the release notes when practical.
If we discontinue the Software entirely (i.e. we no longer publish or sell it), we will make commercially reasonable efforts to provide a final, working installer that does not require our servers to run, but we are not obligated to do so where prevented by law, third-party licensing, or insolvency proceedings.
Privacy
IgniteX runs locally on your machine — your projects and files stay on your disk. What leaves your machine depends on which AI mode you use.
What we do collect:
- Your email, to create your account and sign you in (passwordless, by email link).
- Payment and energy-balance records, plus whatever our merchant-of-record billing provider needs for tax compliance.
- Built-in AI only: the prompts and project context for each turn pass through our gateway to the model provider so we can return the edit and meter energy. We use them to fulfil the request and measure usage. we don't sell them or use them to train models.
- Minimal anonymized telemetry on app version + crash reports, only if you opt in.
What we don't collect:
- The code, scenes, or assets in your projects, beyond the context an AI turn needs to answer.
- An account password. there isn't one; sign-in is by email link.
Note: the model provider behind the AI processes the prompt content for that turn. We have no control over what a third-party provider does with data sent to it; read their privacy policy.
Changes to these terms
We may update these terms. typically to clarify language, comply with new laws, or describe new features. If we make material changes, we'll email you and post a notice at the top of this page for 30 days. Your continued use of the Software after that means you accept the new terms.
The "Effective" date at the top of this page tells you when the current version became active.
Governing law & disputes
These terms are governed by the laws of the European Union (and the country where IgniteX is incorporated, currently the Netherlands), without regard to conflict-of-law principles. Any dispute will first go through good-faith negotiation; if that fails, exclusive jurisdiction is in the courts of the seller's country of incorporation, except where your consumer-protection laws give you the right to sue locally.
You can't bring claims as part of a class action. disputes are individual.
